Release of Jonathan Kuttab’s Memoir.

Read Jonathan’s story that begins as a  child growing up in Palestine before the 1967 Naksa. Going to school in the US, Jonathan became a lawyer, where he worked in NYC/Wall Street. Jonathan in the late 1970s, returned to Palestine working for a church NGO, where he cofounded Al Haq in 1979, and became a member of both the Israeli and Palestinian bar. Read his story–a journey of work in international and human right law, and leadership with civil society and faith based organizations.

The March 9, 2022, Ottawa Forum on Israel Palestine webinar was aimed at helping Canadians better understand Hamas, which Canada describes as a ‘terrorist’ organization and refuses to recognize or deal with. We asked 3 Palestinians with different political perspectives and living in different parts of Palestine to help us understand Hamas.

While each had their own differences with Hamas, their shared view was that Hamas is a Palestinian political party with a broad base of support. Any possible solution to the Israel/Palestine issue will necessarily involve discussions with Hamas. Trying to avoid doing so only makes a solution more difficult.

His latest book is Decolonizing Israel, Liberating Palestine: Zionism, Settler Colonialism and the Case for One Democratic State (London: Pluto, 2021).

Noura Erakat is a human rights attorney and associate professor at Rutgers University, New Brunswick. She has served as legal counsel to the U.S. House of Representatives and as a legal advocate for Palestinian refugee rights at the United Nations. Noura’s research interests include human rights and humanitarian, refugee, and national security law. She is a frequent commentator, with recent appearances on CBS News, CNN, Fox News, and NPR, among others, and her writings have been widely published in the national media and academic journals.

Al-Haq Co-Founder on Israel’s Designation of Group as “Terrorist Organization”

IN OCTOBER, the Israeli government designated six Palestinian human rights groups in the occupied West Bank as “terrorist organizations.”

Jonathan Kuttab, co-founder of Al-Haq, one of the newly outlawed organizations, participated in a Dec. 10 Human Rights Day online discussion sponsored by Al-Haq, the Kashmir Law and Justice Project, the Kashmir Scholars Consultative and Action Network, Stand With Kashmir and Just Peace Advocates.

Kuttab, an international human rights attorney, said Human Rights Day is important because “many people think international law means nothing or it is irrelevant or impotent.” But, he pointed out, “It is what all countries at least verbally commit to and which all countries must be forced to abide by.”

Some governments, including Israel, try to use their power to flaunt international laws by constructing self-serving narratives around issues such as “terrorism,” Kuttab noted. “Those who are in power grant themselves the right to define who is a terrorist and who isn’t,” he said. “But the purported definition has nothing to do with the reality on the ground.” Israel’s laws are not always “in defense of the weak and oppressed, but in defense of the regime, in defense of the oppressors,” he said.

Kuttab pointed to the BDS movement, used by ordinary citizens to put pressure on Israel, as a logical and vital response to the country’s defiant commitment to violating human rights. “This is where the tactics of BDS come in,” he explained. “‘B’ is for boycotting such a country until it respects human rights. ‘D’ is for divesting from a country or a corporation which supports behavior that is oppressive of human rights and violates human rights. ‘S’ is calling for sanctions, which international law does provide for.”

Although some influential countries, especially the U.S., veto United Nations sanction resolutions, “civil society can apply those sanctions through boycotts and divestments,” Kuttab argued. “This is very non-violent, but it is essential and necessary.”

The attorney also warned about the Israeli government using secret evidence and administrative measures. “The term ‘secret evidence’ should shoot up red flags…that somebody is trying…to get away with illegality, sometimes even get away with murder under the guise and cloak of legality,” Kuttab warned. The designation of Al-Haq and five other human rights groups as terrorist organizations is based on “secret evidence which nobody knows,” he noted.

Kuttab pointed out the steep difference between the way Al-Haq and the Israeli government operates. While Israel hides its “evidence,” Al-Haq collects “courtroom-quality evidence to support the statements that we make because we care about truth and we care about facts and we care about being objective in describing the reality on the ground,” he said. “We get evidence and we present this evidence in a transparent manner to the world.”

Kuttab concluded by extoling the vital role civil society plays in holding governments accountable. When governments don’t abide by or enforce international law, “civil society has to step up in a non-violent but public manner to try and bring pressure on those who violate human rights,” he said. “Human rights organizations don’t have guns, tanks, airplanes. They have truth on their side.”

Middle East Peace Talks

Palestinian Professors Jonathan Kuttab and Dr. Manual Hassassian spoke about legal and human rights in the Middle East peace process. Mr. Kuttab explained the complex legal structure of the Israeli occupied territories. Dr. Hassassian traced the experiences of the Palestinian people under Israeli rule in the occupied territories.

This pre-Oslo message is not so different than today. Illegal settlement, apartheid, war crimes/violation of International Humanitarian Law.

“The present Israeli government, while talking a more flexible tone, has really done nothing to dismantle or even cease the process of moving in that direction. A close scrutiny of their words, but more importantly, their action, shows them to be still committed to that course of action. For that purpose and none other, they refuse to meet with a separate Palestinian delegation, but try to subsume it under a Jordanian-Palestinian group. For that reason also, they refuse to freeze the settlements, but continue to build them and come up with spurious distinctions between so-called security and so-called political settlements when we all know that in a militarily sensitive area, you would not move your civilians — your women and children — into a border area, but rather your military. For that reason also, they oppose Palestinian legislative elections, and they set perimeters on the proposed authorities and power of the Palestinian interim self-government arrangements to ensure that they operate within the dual apartheid system that I have mentioned before, believing that Palestinians have no option but to accept that or appear once again rejectionists; believing that they really do not need to meet or address the aspirations of the Palestinian people, but only the sensitivities of American administrations; believing that they can sufficiently obfuscate the issues, that they can proceed with their policies largely unhampered.”
